This Privacy Policy outlines how we collect, use, and share your Personal Information when you visit our website at https://crucialpointagency.com/, use our services, or participate in our referral program.

By using our website or services, you agree to the collection and use of information in accordance with this policy.

1. Definitions

Crucial Point Agency: Refers to the company as the data controller and data processor. Crucial Point Agency also operates under the trading name Symby; references to Crucial Point Agency in this policy include work carried out under that name.

Personal Information: Any data about a living individual who can be identified from that data (or from that and other information either in our possession or likely to come into our possession).

Data Controller: The entity that determines the purposes for which and the means by which Personal Information is processed. For the information we collect on our website, we are the Data Controller.

Data Processor: An entity that processes Personal Information on behalf of a Data Controller. As an email marketing agency, we act as a Data Processor for our clients when we handle their customer data.

Referrer: An individual who participates in our referral program and submits a brand referral to us.

Referred Contact: An individual at a referred brand whose details are submitted to us by a Referrer.

2. Information We Collect

We collect different types of information for various purposes to provide and improve our services to you.

A. Information You Provide to Us Directly:

This includes any information you voluntarily submit to us through our website, such as:

  • Contact Information: Name, email address, phone number, and mailing address.
  • Business Information: Company name, job title, and other details related to your business.
  • Inquiry Information: Any information you provide when you contact us with a question or request.

B. Information We Collect Automatically (Usage Data):

When you visit our website, we may automatically collect certain information about your device and browsing activity, including:

  • Your computer’s IP address.
  • Browser type and version.
  • The pages of our website that you visit.
  • The time and date of your visit.
  • The time spent on those pages.
  • Unique device identifiers and other diagnostic data.

C. Information We Process for Our Clients:

As an email marketing agency, we process Personal Information on behalf of our clients to perform the services they have hired us for. This data may include, but is not limited to:

  • Names and email addresses of our clients’ customers or subscribers.
  • Behavioral data, such as email open rates, click-through rates, and purchase history.
  • Other demographic data provided by our clients for segmentation.

D. Information Submitted Through Our Referral Program:

Our referral program involves Referrers submitting information to us about other people. If you are a Referrer, the information you submit about a Referred Contact may include:

  • The Referred Contact’s name, job title, and employer.
  • Business contact details for the Referred Contact.
  • A description of your professional relationship with the Referred Contact, including whether you currently work with the brand in any capacity.
  • Commercial context about the brand, such as its marketing needs or challenges.

We rely on the Referrer’s representation that they have a genuine professional relationship with the Referred Contact and that no agreement prevents them from making the introduction. We do not independently verify this at the point of submission.

For Personal Information about Referred Contacts, Crucial Point Agency acts as the Data Controller and determines the purposes for which, and the means by which, that information is processed.

E. Referrer Payment and Tax Information:

Where we pay commission to a Referrer, we separately collect and hold financial and tax information for that purpose, including:

  • Payment details, such as Wise account details or bank account information.
  • Tax identifiers and tax documentation, including Form W-8BEN.
  • Commission statements, invoices, and records of remittances made to you.

This information is used only to verify your identity for payment purposes, to make payments to you, and to meet our own tax, accounting, and record-keeping obligations. It is held separately from general contact information and access is limited to the personnel and service providers who need it for those purposes.

3. Use of Your Information

We use the collected information for the following purposes:

  • To Provide and Maintain Our Services: To respond to your inquiries, provide customer support, and perform the contracted email marketing services for our clients.
  • For Marketing & Promotion: To send you our newsletter, promotional emails, and other marketing communications you have consented to receive.
  • To Improve Our Website: To analyze usage trends, track the effectiveness of our campaigns, and improve our website’s functionality and user experience.
  • To Operate Our Referral Program: To review and approve brand registrations, record attribution, contact Referred Contacts about the specific introduction, and calculate and pay commission.
  • To Comply with Legal Obligations: To fulfill legal requirements and enforce our policies, including those related to our Google Ads campaigns.

A. Purpose Limitation for Referred Contacts:

Information about a Referred Contact is used only to evaluate and pursue that specific introduction. It is not added to our newsletter, our general marketing lists, any cold outreach campaign, or any other campaign, and it is not used for any purpose unrelated to that introduction. This applies regardless of the “Marketing & Promotion” purpose described above, which does not extend to Referred Contacts.

B. Notice at First Contact:

When we first contact a Referred Contact, we tell them how we obtained their details, including that they were introduced to us by a Referrer, and we provide a link to this Privacy Policy.

4. Cookies and Tracking Technologies

We use cookies and similar tracking technologies to track the activity on our website and hold certain information. Cookies are files with a small amount of data which may include an anonymous unique identifier. You can instruct your browser to refuse all cookies or to indicate when a cookie is being sent. However, if you do not accept cookies, you may not be able to use some portions of our services.

5. Sharing Your Information

We may share your Personal Information in the following situations:

  • With Our Clients: As an email marketing agency, we share the data we process with our clients to enable them to conduct their marketing campaigns.
  • With Third-Party Service Providers: We use third-party companies and individuals to facilitate our services, such as email marketing platforms (e.g., Mailchimp), website hosting providers, analytics services (e.g., Google Analytics), work management platforms used to receive and review form submissions, and payment providers used to remit commission. These third parties have access to your Personal Information only to perform these tasks on our behalf and are obligated not to disclose or use it for any other purpose.
  • For Legal Requirements: We may disclose your Personal Information if required to do so by law or in response to valid requests by public authorities.

6. Data Security

The security of your Personal Information is important to us, but remember that no method of transmission over the Internet, or method of electronic storage, is 100% secure. While we strive to use commercially acceptable means to protect your Personal Information, we cannot guarantee its absolute security.

7. Data Retention and Deletion

We keep Personal Information only for as long as we need it for the purposes described in this policy. For our referral program, we apply the following retention periods:

  • Rejected referrals: Deleted within 30 days of rejection.
  • Approved referrals that do not convert to a client: Deleted 30 days after the registration lock expires.
  • Referrals that convert to a client: Retained as part of our standard client records.
  • Payment and tax records, including Form W-8BEN and records of remittances: Retained for 7 years, in line with United States tax requirements.

Other Personal Information is retained for as long as necessary to provide our services, comply with our legal and contractual obligations, resolve disputes, and enforce our agreements.

8. International Data Transfers

Crucial Point Agency is based in the United States. If you are located in India or elsewhere outside the United States, the information you submit to us — including your contact details, referral submissions, and payment and tax information — is transferred to, stored in, and processed in the United States, where data protection laws may differ from those in your country.

Where we transfer Personal Information internationally, we rely on the following safeguards:

  • Contractual terms governing your participation in our referral program, which set out how your information will be handled.
